TERMS OF USE (Wallpapers)

DEFINITIONS AND TERMS

In order to understand the rules of the EULA clearly you shall familiarize yourself with the meaning of terms used in the EULA. In this EULA the following terms, when capitalized, shall have the following meanings:

You - means an individual using the App.

Apple – means Apple, Inc., a company incorporated in California, the United States of America, any parent or group company or any successor thereof that operates the Apple mobile platform currently called „App Store".

Application/App – means Our mobile applications and any services provided through the Apps.

Device – means a smartphone, a tablet or another similar mobile device that You either own or otherwise legally control solely for Your lawful, personal, and non-commercial use.

Content – means all kinds of content, including, among other, data, texts, images, videos, sounds, links, software and other pieces of information in any form, which are made available to You through the App.

MCN Global LLC – means app developer from Republic of Belarus.

EEA – means the European Economic Area.

EULA – means this End User License Agreement, which is a binding agreement between You and Us. The EULA may include other documents, like Privacy Policy that regulate relations between You and the Company with regard to using the Application.

Intellectual Property Rights – means, collectively, rights under patent, trademark, copyright and trade secret laws, and any other intellectual property recognized in any country or jurisdiction worldwide, including, without limitation, moral or similar rights.

Platform – means a platform operated by a third party (e.g. "App Store" operated by Apple), where You may access and download the Apps to Your Device.

Policy – means the privacy policy, which describes how We collect, use, process, store and share information that We collect about You, and which is incorporated here by this reference as a part of EULA.

Subscription - means a period, during which You use the App as a whole or certain additional Content for a fee that is charged depending on the type of your subscription.

Services – means Apps and Our related services and products.

Third Party Suppliers – means third party suppliers who offer Content and/or services in conjunction with or through the Services.

INTELLECTUAL PROPERTY

  1. We grant You a non-exclusive, personal, revocable and non-transferable license to access, download and run the App only on Your Device, provided that You agree to comply with all the terms and conditions of the EULA.

  2. The Company or the licensor of the Company is the only holder of Intellectual Property Rights with regard to the our Application. Out Company retains all rights, title and interest in and to the App

  3. You may not sell, resell, copy, rent or lease, distribute, redistribute, sublicense, or in any other way transfer or provide any rights to the App to any third party.

  4. You don't have the right to distribute our application by your own (for example, on any network where the application could be downloaded or used by multiple users at the same time)

  5. You may not decompile, reverse engineer or create derivative works of the App. All your modifications or enhancements to the our App remain the sole property of Company.

CHANGES OF THE EULA

  1. From time to time, we may change this EULA. You should always check the current version of the EULA using the link available inside our application.

  2. If you do not agree with the updated version of the EULA, you should immediately delete our App from all your devices and cancel renewal of your Subscriptions.

UPDATES

  1. We may, though not obliged, update the App sometimes. If We release an update (including a new version of the App) We may request You to update the App. The update may be downloaded and installed automatically or on the basis of Your consent depending on the updates settings of Your Device.

  2. The content of any update of the App is determined exclusively by the Company. We reserve the right to modify or discontinue any part, function, or feature of the App at Our own discretion with or without a prior notice.

SUBSCRIPTION. TRIAL PERIOD

  1. This App as a whole or its certain part is provided on a paid Subscription basis. The fee may vary depending on the type of Subscription you can choose.

  2. The Subscription will renew automatically for the same period at the end of the Subscription at the cost of the chosen package. Your Account will be charged for the renewed Subscription within 24 hours prior to the end of the current Subscription.

  3. You may cancel the subscription you have selected at least 24 hours before the end of the Subscription: in this case the App as a whole or its additional Content will be available to You until the end of the Subscription. After the end of the subscription, all additional paid content of the application will be unavailable until a new Subscription is purchased.

  4. If You uninstall the App, Your subscription will not stop automatically. You must disable the Subscription in the settings of your phone in order not to pay the cost of a new Subscription.

  5. The App provides for a free 3-day trial period. You will have full access to paid content during this period. Take into consideration that at the end of the trial period it will automatically transform into a paid Subscription. After which the cost of the subscription that you selected earlier will be charged from your account, unless You cancel the Subscription through the subscription settings of Iphone at least 24 hours prior to the end of the free trial period.

FEES AND PURCHASE TERMS

  1. The costs of all types of Subscriptions are available on the web-page of the App on the Platform.

  2. When You purchase a Subscription, the Platform Administrator charges Your Account and collects money on Our behalf. The payment is processed by a payment processing system implemented by the Platform Administrator.

  3. Also take into consideration that We neither process Your payment nor have any access to Your payment information.

  4. If you have any questions about the payment processing system, send your request to user support service of the Platform.

  5. Your Account is charged with the cost of the new Subscription within 24 hours prior the end of the current Subscription. If You cancel automatic renewal within the last 24 hours of the Subscription, such cancellation will take effect at the end of the new Subscription.

  6. Keep in mind that We do not make refunds. The digital content is made available to You immediately after the Subscription fee is charged to Your Account.

DISCLAIMER

  1. To the extent this is permitted by applicable law, all MCN Global LLC apps are provided on an "as is," "with all faults," and "as available" basis, and you use them at your sole risk. subject to applicable law, on behalf of itself, and its affiliates, officers, employees, agents, partners, and licensors, expressly disclaims any and all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any other warranty.

  2. We make no warranty that:
    our App will meet Your requirements;
    our App will be error-free, secure, or uninterrupted;
    any App functionality errors will be corrected;

  3. The entire risk arising out of use or performance of the MCN Global LLC apps remains solely with you. IAC expressly disclaims all warranties relating to products and/or services provided by third party partners.

  4. Under no circumstances shall Our liability or of any of Our affiliates pursuant to any cause of action, whether in contract, tort, or otherwise, exceed the fee paid by You for access to the Apps. Furthermore, We shall have no responsibility or liability for delays or failures due to circumstances beyond Our control.

  5. This disclaimer or warranty constitutes an essential part of this agreement.
