These Terms of Use ("Terms of Use") are the basis on which you are granted access to the use of the software applications (downloaded from the Apple App Store or Google Play), including, without limitation, any corrections, updates, enhancements or substitutions to them (collectively, the "Application") and the online services (the "Service", any reference to the Services also includes the Application) provided to you by MCN Global LLC ("we" or "MCN Global LLC"). These Terms of Use govern all uses and functions offered through the Services, which may become available from time to time. Please read these Terms of Use carefully before using the Services. By accessing and using the Services, and/or downloading and/or installing and using the Application in any way, you agree to and are bound by these Terms of Use. USE OF THE SERVICE
The service uses a unique technology that allows you to choose songs from a database provided to you by LLC "MCN Global". The service is provided solely for non-commercial use by individuals.
As a condition of using the Service, you agree not to use the Service for any purpose that is illegal or prohibited by these Terms of Use. You may not distribute any part of the Service in any medium without the prior written permission of LLC MCN Global. You also agree not to change or modify any part of the Services or any related technology.
IMPORTANT: In order to use the Service, you must obtain data connectivity services from your service provider. The cost of the data connection service may vary and depends on your service provider. It is your responsibility to check these costs and determine whether or not you want to bear them. In particular, you also acknowledge that the cost of such data connectivity services can increase significantly when using international roaming. Therefore, we recommend that you consider the cost of using the Service depending on your location at any given time.
USER ACCOUNTS.
The services provided on the Website or in the Application may require you to create an account; you must complete the registration process by providing up-to-date, complete and accurate information in accordance with the proposed registration form. You must also choose a password and username. You are solely responsible for maintaining the confidentiality of your password and account. If the Application is used via Facebook, no further registration is required and your Facebook login details will be used to login to the Service. In addition, you are solely responsible for any activities that occur under your account. You agree to immediately notify MCN Global LLC of any unauthorized use of your account or any other breach of security. MCN Global LLC will not be liable for any damages that you may suffer as a result of someone else using your password or account, with or without your knowledge. You can never use someone else's account.
License. Subject to your full compliance with all the terms of this Agreement, LLC MCN Global LLC hereby grants you a limited, personal, non-commercial, non-exclusive, revocable, non-volatile, non-technical, non-technical, and non-technical license.

You acknowledge that the Service and its contents are provided to you on an AS IS basis for your personal use only and, except as permitted by these Terms of Use, may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise used for any other purpose without the prior written consent of MCN Global LLC or its respective owners.
USER REPRESENTATION.
MCN Global LLC may allow you to add, create, send, distribute or publish certain content, including, without limitation, text, photographs, videos, data, graphics and information (including, without limitation, personal information and location-based services information (each a "User Submission") through the Service. By submitting any User Submissions through the Service, you are (a) confirm that you publish this User Submission and that you may be publicly identified by your User Name in connection with this User Submission; (b) understand that whether or not this User Submission is published, LLC "MCN Global" LLC does not guarantee and is not obligated to maintain confidentiality with respect to any User Submission, and agree that any User Submission provided in connection with the Service is provided on a non-proprietary and non-confidential basis; (c) represent and warrant that you own or have all necessary rights and permissions to use and authorize MCN Global LLC and the users of the Service to use all intellectual property rights with respect to any User Submission and to allow their inclusion and use in connection with the Service This license includes the right to use the User's Submission to promote and advertise the Service, making it available to others to distribute or publish such User's Submission on other media and services, without compensation to you in respect of the User's Submission that you submit, publish, transmit or otherwise make available through the Services; (f) hereby agree that LLC "MCN Global" LLC may post advertising and promotional materials about or in relation to the Service, in connection with your User
In addition, you acknowledge and agree that you are solely responsible for any User Submission submitted by you and for the consequences of posting or publishing such User Submission, and you waive any "moral rights" with respect to such User Submission.
You understand that by using the Service, you may be subject to a User Submission from a variety of sources, and that LLC MCN Global LLC is not responsible for the accuracy, usefulness, security, or intellectual property rights associated with such User Submission. You may encounter inaccurate, offensive, obscene or undesirable User Submissions, and you agree to waive, and thus effectively waive any legal or moral rights or remedies that you may have against MCN Global LLC in respect of it in any way, and you agree to release and indemnify MCN Global LLC (b) The Service may not be used by any third party due to or in connection with content that you submit, post or transmit through the Service, including reasonable attorneys' fees, its affiliates and their respective directors, officers, employees and agents.
THIRD PARTY WEBSITES AND CONTENT.
MCN Global LLC does not and cannot view all materials, information and content available on or through third party websites and web pages to which the Service links and transmits information to the website ("Third Party Content") and therefore cannot be held responsible for such third party content. When you use LLC "MCN Global" does not represent or imply that it endorses such website or web page or any content on them. You are responsible for taking the necessary precautions to protect yourself and your computer systems from viruses, worms, Trojan horses and other harmful or destructive content. MCN Global LLC is not liable for any damage caused by your use of third party websites and web pages.
We respect the intellectual property of others and ask our users to do the same. The Service allows you to transfer Third Party Content through the Application in accordance with the terms and conditions of the third party websites and in accordance with the terms and conditions of such websites and APIs. As a condition of using the Service, you agree not to use the Service to infringe any intellectual property rights. We reserve the right to terminate accounts or block access to the Service for any user who violates any intellectual property rights.
NON-Global LLC "MCN Global" WILL NOT be ABOUTED BY ANY CONTENT OF THIRD PARTIES, INCLUDING, WITHOUT LIMITATION, ANY ERRORS OR OMISSIONS IN ANY THIRD PARTY CONTENT, OR FOR ANY INFRINGEMENT RESULTING FROM THE USE AND/OR DISPLAY OF ANY THIRD PARTY CONTENT THAT HAS BEEN TRANSFERRED, DISPLAYED AND/OR OTHERWISE MADE AVAILABLE ON THE WEBSITE AND/OR APPLICATION.
In addition, the Third Party Content is subject to the terms and conditions of use of that third party provider and your use of the Service, which you agree to and which you approve, and you are subject to the terms and conditions of use of that third party content provider.
ABUSIVE, INAPPROPRIATE AND INAPPROPRIATE CONTENT. You understand and agree that MCN Global LLC may (but is not obligated to) review and remove or block any content of any kind that, in its sole discretion, MCN Global LLC LLC violates these Terms of Use or may be offensive, illegal, inappropriate, inappropriate, inappropriate, or infringing on the rights, damages, or endangers the safety of third parties and/or other users of the Service (the "Insulting Content"). MCN Global LLC DOES NOT WARRANTY WARRANTY WHICH ON WHICH SERVICE WILL BE YOUR WITH YOUR STORADY OR WHICH DATA AND SERVICE, THE SERVICE WILL BE ACCURATE, RELIABLE OR UP TO DATE, OR THAT THE SERVICE WILL BE AVAILABLE ON A CONTINUOUS, SECURE OR FREE BASIS. YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR OWN RISK AND THAT ALL RISK RELATING TO THE RESULTS OF THE SERVICE, INCLUDING, WITHOUT LIMITATION, ANY DAMAGE TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE USED TO ACCESS THE SERVICE OR STORE DATA ON SUCH DEVICE, IS SOLELY YOURS.
LIMITATION OF LIABILITY

YOU acknowledge and agree that LLC MCN Global LLC may change the SERVICE FOR OUR PURPOSE OR its affiliates WITHOUT NOT INTRODUCTION FOR YOU and NOT BEFORE YOU ANY RESPONSIBILITY IN THE BOARD OF THIS LIABILITY.
EXEMPTION FROM LIABILITY. You agree to defend, indemnify and hold harmless MCN Global LLC (b) You agree to indemnify, defend, hold and hold harmless its affiliates, officers, directors, employees and agents from any and all claims of any kind, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with such claims: (i) your use of and access to the Service; (ii) your violation of any term of these Terms of Use; (iii) your violation of any right of a third party, including, without limitation, any copyright, proprietary right or right to privacy; or (iv) any claim that your User Submission has caused damage to a third party. MCN Global LLC may terminate your access to all or any part of the Service at any time, with or without cause, and with or without notice, and the decision is effective immediately and may result in the destruction of all information and data associated with your account. If you want to close your account, you can do so by removing the Application from your device and removing the Application from "Your Applications" in the Application Centre of your Facebook account. If you close your account, your profile will be removed from the Service, however, the deletion may not be immediate and MCN Global LLC may continue to store your personal information in its accounts for billing, auditing and other administrative purposes.
APPLICABLE LAW AND JURISDICTION. You agree that any action taken against MCN Global LLC in connection with or relating to the Service or these Terms of Use may be brought exclusively before the competent courts.
ANY CAUSE OF ACTION ARISING OUT OF OR IN CONNECTION WITH THE WEBSITE OR THE APPLICATION MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ARISES. Otherwise, such MAINTENANCE OF THE SKI is IMPLIED FORBIDDENCE.
GENERAL PROVISIONS
These Terms of Use and any other legal notices published by LLC MCN Global LLC on the Website or in the Appendix constitute the entire agreement between you and LLC MCN Global LLC with respect to the Service. If any provision of these Terms of Use is held invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect.
